[FoodBuzz] provides an AI-powered image processing platform designed to enhance, clean, and style food and culinary photographs ("Enhanced Content") from user-provided images ("Source Content").
2. Accounts and Free Trials
- Account Creation: You must provide accurate information when creating an account (via Google OAuth or email). You are responsible for safeguarding your credentials.
- Free Generations: Each authenticated account can try 2 free generations. These are a one-time trial and do not renew. Automated creation of multiple accounts, use of disposable email addresses, or scripted exploitation to claim additional free generations is strictly prohibited and will result in immediate termination and IP banning.
3. Lifetime Access, Payments & Refunds
- Billing: Lifetime access is offered for a one-time payment at the price shown on our pricing page. There are no recurring charges or automatic renewals. Payments are handled by the payment processor identified at checkout.
- Generation Access: Active lifetime access allows unlimited generations without a credit balance or monthly allocation. Up to 2 generations may be active at once. Generation availability remains subject to service availability and these terms.
- 30-Day Money-Back Guarantee: If you are unsatisfied with our service, you may request a full refund within 30 days of your initial purchase, provided that you have generated fewer than [10] photos after your purchase. Accounts that exceed this usage threshold or violate these terms are ineligible for refunds. See our Refund Policy for details.
- One-Time Purchase: Lifetime access has no recurring billing period to cancel. To request a refund, follow the process in our Refund Policy.
4. Intellectual Property & Image Ownership
- Your Source Content: You retain all rights and ownership of the original images you upload to the platform. You represent and warrant that you own or have the necessary licenses and permissions to use and modify the images you submit.
- Enhanced Content: Subject to your compliance with these Terms and payment of applicable fees, you own all rights, title, and interest in the Enhanced Content generated through the Service, including the right to use such images for commercial delivery platforms (e.g., Uber Eats, DoorDash, Glovo), menus, social media, and advertising.
- License to Us: You grant us a limited, worldwide license to host, store, and process your images solely to provide and operate the Service. We do not sell your images to third parties.
5. Prohibited Uses
You agree not to use the Service to:
- Upload illegal, infringing, defamatory, or non-culinary illicit imagery.
- Reverse engineer, decompile, scrape, or extract the underlying AI models or algorithms.
- Resell, rent, or lease access to the platform without prior written agreement.
- Interfere with the security or integrity of our servers and network infrastructure.
6. AI Output & Menu Accuracy Disclaimer
- Authenticity: Our tool is designed to enhance lighting, backdrops, and presentation. However, AI-generated enhancements may occasionally produce visual inaccuracies or artifacts.
- User Responsibility: You are solely responsible for ensuring that any final images published on delivery platforms, menus, or promotional channels accurately represent the actual dishes, portions, ingredients, and allergen specifications served to your customers.
- Compliance: We are not liable for any customer disputes, regulatory fines, or platform bans (e.g., penalties from delivery apps) arising from discrepancies between your actual food and the enhanced images you choose to publish.
7. Limitation of Liability
To the maximum extent permitted by applicable law, [FoodBuzz] and its founders, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or business interruption resulting from your use of or inability to use the Service. Our total liability for any claim arising out of these Terms shall not exceed the amount paid by you to us in the twelve (12) months preceding the claim.

We reserve the right to modify these Terms at any time. Material changes will be communicated by updating the date at the top of this page or via email notification. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
